TO PROVIDE DOMESTIC HELPER SERVICES AGREEMENT

This agreement between Narayan Home Facility Service Pvt. Ltd. (hereinafter referred to as) with their office at Plot No-06, Basement Sarpanch house village-Tigra, Sector-57, Near Lotus valley School Gurugram-122001 Through duly authorized by MD. Sanjeet Ray (Mob: - 9560443068).

1. Domestic Helper Take the responsibility of your family member and take care of their basic needs and fulfill them such as: - Provide proper facilities like accommodation, food, soap, oil, medicines, clothes etc. and take care of them.

2. Domestic Helper It is mandatory to give 2 leaves to the every month and if the Domestic Helper does not take 2 leaves in a month, then you will have to pay extra salary for that leave or according to the Domestic Helper, you can give them more leave in the next month.

3. Police verification of Domestic Helper will be given to you by the company and the police will give it to you after getting the verification done. He will be on the authority of the company. If you want your rights then you will have to personally go to your nearest police station and get the police verification done.

4. If you are ever going out of the city, you cannot leave the Domestic Helper locked in your house and you can keep the Domestic Helper at the company's P.G. as per the arrangement of the company. And you will have to pay the food and drink expenses of the domestic for keeping him on PG, which will be ₹ 200 per day. You will have to pay this expense in advance

5. Whenever you give leave to Domestic Helper or if Domestic Helper wants to go on leave due to important family work, then you should inform the company before giving leave. The company sends any of its officers/Office Rider to pick them up or gives you permission only then you give them leave or you send them.

6. The company can take appropriate legal action against you in case of any complaint like beating, teasing, or abuse or using objectionable words or misbehavior with the Domestic Helper. And the deposit amount/Service Charge given by you to the company will be confiscated.

7. If for some reason the Domestic Helper goes missing or any accident happens to them, then you should first inform the company and you yourself must file a police missing report.

8. If the Domestic Helper is unable to work due to any reason, we will make a replacement as soon as another Domestic Helper is available with us or if it is not available, you will give the company 15 working days to make the replacement.

9. If you are dissatisfied with the work of the Domestic Helper given by the company, then the company will replace you Domestic Helper thrice. Therefore, if you are still not satisfied with the work of the company's Domestic Helper, then the company will cancel the validity of your agreement. And the deposit amount/rupees will not be refunded.

10. If you terminate the agreement prematurely for any reason (you will have to give a notice of 1-month prior, if you terminate agreement without giving notice, then no Refund will be given to you terminate agreement by geven notice then) Time you have taken the service of the company. (After Deducting Service Charge For The Number Of Days The Company Has Been In Service) After deducting that much amount from your deposit and the remaining amount (50% Canceled Charges), the remaining amount will be returned to you within 15 days.

Plus Company Charges 25,750/- + T@x excluded ( *18%GST* ) One Time Payment In 12-Month ( *3-Staff* ) Replacement Free Guarantee & After Per Replacement 1500/- Convince Service Charges Extra.. *This Charges Not Refunded Only Replacement etc..*

Plan C. : *Diamond Plan*

Plus Company Charges 40,750/- + T@x excluded (*18%GST* ) One Time Payment In 22-Month ( 6-Staff ) Replacement Free Guarantee & After Per Replacement 1500/- Convince Service Charges Extra.. *This Charges Not Refunded Only Replacement etc..*

12. The amount of salary that will be decided for the Domestic Helper can be given to the Domestic Helper yourself or the company can also give the amount of salary. And apart from the salary, things like giving advance clothes, goods etc. will be your own responsibility.

13. Whenever you provide salary, it should be necessary for the company to inform about it. When the Domestic Helper does not want to work, then the salary for the last month of his/her working month has to be provided by the company.

14. When Domestic Helper is being sent or brought to you by us, then you should search or check their goods yourself so that both you and the company remain safe in the future.

15. If the domestic helper given by us ever commits any kind of mistake or wrongdoing, then the company will not compensate for it. Also, the company will cooperate with you in those circumstances and in case of dispute, the settlement will be in the court area of Gurugram only.

16. The salary amount of Domestic Helper given by us may fluctuate at the time of replacement. Domestic Halper will bear one way fare for you while going on leave.

17. If the address and facts given on the agreement submitted by you are found to be incorrect, your deposit amount/Service Charge will be confiscated and the company will be forced to take legal action.

18. While making the agreement, you will have to hand over the photocopy of any of your documents like Voter Card, Aadhar Card, PAN Card, Passport etc. While making the agreement, it is mandatory to give the names and mobile numbers of 2 witnesses from your side.

19. If you change your address and mobile number after signing the agreement, then in such a situation it is mandatory to inform the company in writing. Or if you are going out of the city and take a domestic helper with you, then it is mandatory to inform the company.

*Payment Term*

1. The company accept the payment of all bill by (Phone Pay / Google Pay / Paytm / Cash) Reconciliation of Accounts and Balance Confirmation

The company and …………………. Will sign off Balance at the end of each month after arriving at a mutually agreed balance.

*Dispute Resolution*

All disputes and differences that may arise between the parties hereto in regard to or touching these presents. Carrying out of terms and conditions herein under and / or the interpretation there of in any way whatever or as to construction, meaning, validity or effects of this agreement or any clause, matter or thing herein coordinate the rights and liabilities of the parties herein under shall be settle as per Indian Laws.

*Jurisdiction*

All matters concerning these presents shall be subject to Gurugram Jurisdiction.

*Termination of the Agreement*

Either party may terminate the Agreement by giving notice of 30 days in writing to the other party. The parties shall discharge their respective obligation under the Agreement during the notice period.

*Force Majure*

Company shall not be liable for any failure or delay in performance of its obligation under this Agreement, if that is caused by force measures, earthquake, floods fire, riots, strike or like circumstances. IN WITNESS WHEREOF, The parties hereto have caused this Agreement to be executed as of the date first written above
